SSW’s win before the National Appeal Chamber

On 22 July 2019, the National Appeal Chamber took account of the appeal lodged by SSW Pragmatic Solutions on behalf of one of its clients.

The proceedings concerned the implementation of the IT system that presented and promoted the scientific achievements and the research capacity of a  group of eight Polish universities.

In its ruling, the Chamber confirmed the reasoning of the appellant concerning the correct distinction of the conditions for participation in the proceedings and the evaluation criteria for tenders relating to the contractor’s experience from the detailed technical requirements concerning the future implementation being the subject of the contract.

The Chamber ordered the re-evaluation of the tender and inclusion in the evaluation criteria for tenders relating to the experience of reference projects presented in the submitted documents.
