Breakthrough success of SSW in an arbitration dispute with Subway
The experts from the court and arbitration proceedings team of SSW obtained a fully positive award in an international arbitration dispute. The proceeding commenced by Subway International B.V. was conducted in New York, administered by ICDR/AAA (International Centre for Dispute Resolution / American Arbitration Association), on the basis of the UNCITRAL Arbitration Rules.
Our lawyers represented a Polish franchisee against whom the Subway chain lodged claims for, inter alia, payment of monies due, termination of franchise contracts, discontinuation of using of Subway’s trademarks. The international arbitration tribunal dismissed all Subway’s claims against our client. In the reasons for the award, the tribunal emphasised the high quality of written submissions presented by SSW.
This breakthrough success constitutes a precedent and will shape arbitration awards in many similar cases, including in other Subway arbitration cases handled by SSW.
