Victory in railway infrastructure dispute – SSW prevails before the National Appeals Chamber and the Regional Court
SSW successfully represented a leading Polish railway infrastructure company in appeal proceedings before the National Appeals Chamber (Krajowa Izba Odwoławcza) and in complaint proceedings before the Regional Court in Warsaw concerning the design and construction works on the C-E 20 railway line.
The case concerned claims raised by a competing contractor regarding the contracting authority’s decision to reject its tender and to select our client’s bid as the most economically advantageous offer.
The Regional Court in Warsaw fully upheld the arguments presented by the SSW team and dismissed the competitor’s complaint. As a result, the favourable outcome for our client was maintained, paving the way for the execution of the contract and the implementation of the investment project.
The client was represented by Michał Bagłaj, Partner and Head of the Public Procurement Practice, and Katarzyna Szpilko, Associate.
This ruling highlights the importance of effective legal representation in public procurement proceedings and appeal disputes, which may ultimately determine the delivery of strategic infrastructure projects.
