We advise both public authorities and tenderers on all aspects of public procurement law and good practices. We can help you at every stage of the public procurement procedure, including during and after project implementation.

We ensure that you are fully prepared for the procurement procedure and successful project implementation. We ensure full compliance with procurement rules, including by identifying, preventing and remedying any potential conflicts of interests.  We help you to make the best use of technical dialogues, to minimise risks associated with creating procurement documentation, and to properly organise any contact between the participants of the procurement proceedings. In the event of any procurement-related disputes, we would represent you before the National Chamber of Appeal or the common courts, as relevant.

Advising public authorities (as the ordering party):

  • Conducting comprehensive reviews of draft procedure documentation – announcements, Terms of Reference, tender descriptions etc.;
  • Preparing draft contracts, including the use of agile methodologies
  • Helping to prepare answers to requests for further explanations of procurement documentation and/or to amend procurement documentation;
  • Reviewing applications for participation in public procurement proceedings or offers;
  • Preparing draft notices to be sent to contractors, including notices to submit documents, to explain a tender offer or procurement price etc.;

  • Advising on inspections or other proceedings conducted by the Public Procurement Office;
  • Advising on proceedings concerning so-called financial adjustments imposed on the beneficiaries of EU aid.

Advising private contractors (as the tender supplier):

  • Conducting comprehensive reviews of procurement documentation (e.g. Terms of Reference, tender descriptions, draft contracts and announcements) to confirm their validity;
  • Helping to devise the most effective structures for participating in the proceedings, including relationships with consortia, subcontractors and other business partners;
  • Supporting the preparation of applications to explain the procurement documentation,
  • Supporting the preparation of applications to participate in the public procurement proceedings or offers and accompanying documentation;
Advising private contractors (as the tender supplier):
  • Preparing draft answers to any notices sent by the ordering party (e.g. notices to submit documents, to explain the offer or procurement price etc.);
  • Assisting/conducting negotiations with the ordering party;
  • Drafting and amending public procurement contracts;
  • Representation in proceedings before the National Chamber of Appeal and common courts.
