Favourable decision on withdrawal of a permit to pursue the occupation of road transport operator

SSW’s Environmental protection team has once again achieved a significant success in administrative proceedings. Our lawyers successfully represented one of the leading entities in the logistics industry in a case concerning the revocation of a permit to pursue the occupation of a road transport operator.

The complex nature of the case was primarily due to the need to challenge the findings contained in the inspection protocol carried out by the Main Inspector of Road Transport and the actions taken against the client. The adopted procedural strategy, the proposed interpretation of the provisions of Regulation (EC) No 1071/2009 of the European Parliament and of the Council and the submitted motions for evidence made it possible to successfully conclude the administrative proceedings.

In the justification of the decision, the Main Inspector of Road Transport fully shared the argumentation of our lawyers, indicating that the evidence collected in the case did not allow for attributing fault to the controlled entity and for this reason it was necessary to discontinue the proceedings. Such a conclusion of the case made it possible to avoid severe financial penalties and the risk of suspension of the activity conducted throughout Europe.
